Terms of Service

1. Acceptance of Terms
By accessing or using the Tradeify AI Trading Platform ("Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you may not use the Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into contracts. Use of this Service is restricted to individuals who are eligible to trade securities in their jurisdiction. You must comply with all local laws, rules, and regulations related to stock trading.
3. Subscription Plans and Billing
Tradeify offers three subscription tiers, each combining a fixed monthly fee with a profit-sharing component. Fees and profit shares are charged automatically as described below:

Monthly Fee & Profit Share
- The fixed monthly fee is automatically charged at the start of each billing cycle.
- Profit share is calculated at the end of each month based on net realized profits and charged automatically. Losses are never charged.
- Users have access to a monthly statement showing net profits, applicable profit share, and total fees.
Yearly Subscriptions
- Users may prepay the monthly fee portion for 12 months to receive a 15% discount.
- Profit share continues to be calculated monthly and is not affected by the yearly prepayment.
Cancellation
- You may cancel your subscription at any time.
- No refunds are provided for partial months or profit-share charges already applied.
4. Brokerage Integration
- Tradeify connects with select brokers (currently Alpaca, Tradier, and Interactive Brokers) to retrieve trading data and execute trades if enabled.
- Users are responsible for maintaining their brokerage accounts and complying with brokerage terms.
- If your brokerage is not supported, Tradeify may offer to help you open an eligible account.
5. Trading and Algorithm Disclaimer
- Tradeify provides algorithmic trading tools and analytics, not financial advice.
- All trading involves risk. Past performance does not guarantee future results.
- Users are responsible for all trades executed and must understand that losses are possible.
- Tradeify does not guarantee profit under any circumstances.
6. Account Security
- Users are responsible for maintaining the confidentiality of their login credentials.
- Tradeify will not be liable for unauthorized access due to user negligence.
- Multi-factor authentication is strongly recommended.
7. Intellectual Property
- All content, software, algorithms, graphics, and documentation are owned by Tradeify and protected by copyright and other intellectual property laws.
- Users may not copy, reverse-engineer, or redistribute the Service without written permission.
8. Termination
- Tradeify reserves the right to suspend or terminate accounts for violation of terms, fraudulent activity, or security risks.
- Users may terminate their own accounts at any time through the dashboard.
9. Limitation of Liability
- Tradeify is provided "as is" and without warranties.
- Under no circumstances will Tradeify be liable for loss of profits, data, trading opportunities, or indirect, incidental, or consequential damages.
- Maximum liability is limited to the total subscription fees paid in the last 12 months.
10. Indemnification
You agree to indemnify Tradeify and its affiliates against all claims, losses, damages, or expenses arising from your use of the Service, breach of terms, or violation of laws.
11. Governing Law
- These Terms are governed by the laws of the State of California, USA.
- Disputes will be resolved in the courts located in San Francisco County.
12. Modifications
Tradeify may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
